SUBJECT:     Report on Broward League of Cities, Florida League of Cities, Broward County Commission and Florida Association of Counties Legislative Issue of Concern CAD #008/08

Purpose:

 

Prepare a Comprehensive Review of the Broward League of Cities 2008 Legislative Action Plan, Florida League of Cites 2008 Legislative Action Agenda, Broward County Commission’s 2008 Legislative Program and the Florida Association of Counties 2008 Legislative Program to review the positions presented by these organizations and make recommendations on whether the City Commission should support or oppose these proposals in a Resolution or Resolutions to the Florida Legislature.

 

Background:

 

The Broward League of Cities, the Florida League of Cities, Broward County and the Florida Association of Counties have historically prepared a proposed legislative plan, agenda or program identifying the issues these organizations have recognized as impacting their members, and establishing a position for their members either supporting or opposing the issue. These organizations have in the past submitted these legislative positions to the City Commission for review and sought the City Commission’s support for their proposal. Every year previously, the City Commission has considered these proposals individually and considered adopting a Resolution in support of these organizations. This year staff is presenting all of the legislative proposals in a comprehensive package which identifies those issues where the organizations agree and overlap and issues that these organizations are pursuing individually.  Staff has prepared a Summary of each of the proposals which addresses only those issues within the proposal that Staff has identified as potentially impacting the City, either positively or negatively, and Staff has included recommendations to the City Commission as to the effect of these proposals. The package will be supplemented with hard copies of each of the organizations proposals that will include notes from staff on whether issues are identical, vary, or are addressed at all in the other organizations proposals.

 

Discussion:

 

The Broward League of Cites and the Florida League of Cities have each identified those issues that they will be lobbying in support of or against during this Legislative Session.  Staff has reviewed and summarized their Action Plan and Agenda and summaries of these proposals are attached as Attachments 1 and 2. Because all of the issues within the Broward League’s Plan and the Florida League’s Agenda have a potential impact on the City, each issue is addressed in the respective summary. Staff indicates its recommendation below each issue in each summary. Staff has recommended all of the positions within The Florida League of Cities 2008 Action Agenda be supported.

 

The Broward County Commission has adopted a twenty-one page Legislative Program which to a large degree mirrors the Florida Association of Counties’ Legislative Program. Staff has reviewed and summarized the Program and has prepared a summary which is attached as Attachment 3. Staff has determined that not all of the issues present a potential impact to the City so only those that may have an impact have been addressed.  Staff indicates its recommendation below each issue in each Summary.

 

The Florida Association of Counties has adopted a forty-one page Program which addresses in great detail the issues and positions of the Association.  A summary of the Program is contained on Attachment 4.  Again, many of the issues have no impact on the City of Hallandale Beach and therefore staff has prepared a Summary of the Florida Association of Counties 2008 Program which addresses only the issues of impact for the City. Staff indicates its recommendation below each issue in each summary.

 

Recommendation:

 

The City Commission:

 

1.         Review the Summaries and the source documents, the Broward County League of Cities 2008 State Legislative Action Plan, Florida League of Cities 2008 Legislative Action Agenda; Broward County 2008 State Legislative Program and the Florida Association of Counties 2008 Legislative Program to determine if the Commission wishes to endorse fully, in part or not at all each of the proposals.

 

2.         Authorize staff to prepare a Resolution or Resolutions in accordance with the Commission’s direction and authorize the Mayor to execute the Resolution on behalf of the City.
