SUBJECT:     2007-2008 Legislative Issues, Priorities and Action Plan

 

 


PURPOSE:

 

Consideration of Resolutions relating to the City’s 2007-2008 Legislative Issues, Priorities and Action Plan.

 

BACKGROUND/DISCUSSION

 

At the December 18, 2007 Special Commission Meeting, the Commission directed the preparation of Resolutions supporting or opposing legislation and related issues.  Resolutions are attached for Commission consideration beginning with Item 7.E. and continuing through Item 7.N.

 

The following Resolutions are attached:

 

  1. Supporting Senate Bill SB816 Proposed by Florida Senator Mike Bennett; Creating an Act Relating to Uniform Traffic Control; Creating the "Mark Wandall Traffic Safety Act"

 

  1. Supporting A Complete Review and Analysis of the Proposals Before the Taxation and Budget Reform Commission Pertaining to Florida Sales and Use Tax Provisions to Remove Exclusions and Exceptions for Purposes of Providing Revenues for Schools in Florida.  Mayor Cooper has submitted a letter to the Taxation and Budget Reform Commission regarding this matter and this Resolution will further document the City’s position.

 

  1. Supporting Legislative Approval of a Tribal Gaming Compact, as Opposed to Unilateral Execution of the Current Compact by Governor Charlie Crist.

 

  1. Supporting Senate Bill 84 Expanding the Number of Grants a Local Government May Apply for to Acquire Land for Outdoor Recreation Activities, and to Further Support Legislation to Expand the Number of Grants Overseen by the Department of Community Affairs that a City May Apply For

 

  1. Opposing Senate Bill 392 Requiring Local Governments to Report to the Department of State Contract Expenditures Made Pursuant to a Contractual Agreement of Over Five Thousand Dollars

 

  1. Opposing the Additional Requirements for Building Inspector Qualifications in Broward County and Urging the State to pass Legislation creating uniform requirements

 

  1. Urging the Florida Legislature to Consider Legislation Authorizing Local Review Authority in the Determination of Municipal Population by Authorizing Local Governments to Analyze, Verify and Submit Corrective Data to Ensure the Calculation of Local Population is an Accurate and Complete Accounting.

 

  1. Urging the United States Congress to Consider Legislation Authorizing Local Review Authority in the Determination of Municipal Population for the US Census

 

  1. Supporting House Bill 27 Increasing the Percentage of Foreign Investment for the

      Firefighter's Pension Trust Fund

 

  1. Urging the Broward County Charter Review Commission to Support the Recommendations from the Broward League of Cities Board of Directors Pertaining to Changes in the Composition of the Broward County Planning Council (directed by the Commission at the December 19th, City Committee Meeting)

 

In addition to the above resolutions, at the December 18, 2007 Special Meeting the City Commission directed staff to draft the below listed resolutions.  These resolutions have not been prepared for the reasons described below.

 

  1. Opposing Committee Member Lacasa’s proposals regarding the elimination of the School Board portion of the property taxes and replacing them with increased sales tax – Lacasa outlined his proposal and it was reported in the media, however, to date no proposal has been submitted to the Taxation and Budget Reform Commission.  Once a proposal is formally submitted Staff will draft the appropriate resolution for the Mayor’s signature and forward same to the State. 

 

  1. Opposing two local bills addressing a Special Fire Tax District and Creating a Commission to review all Special Districts in Broward County – These two bills were pending at the time of the Commission meeting but were subsequently withdrawn from the Broward Delegation and will not be brought before the Florida Legislature.

 

  1. Urging Congress to Oppose Legislation that Preempts State and Local Laws over Collective Bargaining for Public Safety Employees – The bill currently has no movement.  If the bill should move forward, staff will do an evaluation and bring the Resolution to the Commission.

 

RECOMMENDATION:

 

The City Commission consider adoption of Resolutions related to the City’s 2007-2008 Legislative Issues, Priorities and Action Plan.
