SUBJECT:     Posting Zoning and Land Development Public Hearings CAD# 032/07

PURPOSE

 

To discuss posting requirements for development related Public Hearings.

 

BACKGROUND

 

At the meeting of June 20th, 2007, the Commission discussed the posting of properties involving rezoning, land use plan amendments and approval of major development plans prior to hearings before the Planning and Zoning Board and the City Commission.   Staff was directed to prepare a code amendment and bring back to the Commission when ready.

 

At the meeting of September 19, 2007, the City Commission directed that an item be placed on the commission agenda to further discuss the posting of signs for certain development related applications.

 

DISCUSSION/CONCLUSION

 

Presently, the City’s Zoning and Land Development Code requires posting of properties being considered for public hearings, however, there is no specific size requirement of the posted sign nor a specified time period that the sign be posted prior to a public hearing.  Various sign sizes were discussed at the meeting held on June 20th, 2007.  The Domus project, approved by the City Commission on September 5th, 2007 was used as a test case and the developer was directed to post the property with a sign four feet by six feet (4 ft X 6 ft) in size, seven days before the City Commission Public Hearing.

 

The City Commission should discuss the matter and direct staff accordingly.  It is Staff’s recommendation rather than process a Code amendment that could take a number of  weeks and cost approximately $1,000 in advertising, that the new size requirements for the signs be implemented through Administrative Policy. 

 

By incorporating the size requirement into an Administrative Policy, these requirements would become effective immediately. In the future, should the Commission desire to modify this requirement it could be done immediately rather than through the process of amending the Code.

 

 

 

 

Staff further recommends that the 4’x6’ sign be posted 10 days prior to Hallandale Beach Planning and Zoning Board, and/or City Commission, and/or Broward County Planning Council review.
