SUBJECT:     An Ordinance of the City of Hallandale Beach, Florida, Amending the City Code of Ordinances, Chapter 18, Occupational Licenses, Article II "Local Business Tax," Section 18-40 "Suspension or Revocation of Occupational License"; Providing for Conflicts; Providing for Severability; and Providing for an Effective Date.

 

 


On May 2, 2007, the City Commission approved the Ordinance amendments and set Second Reading for May 16, 2007. 

 

Chapter 18 of the City’s Code of Ordinances “Local Business Tax” sets forth suspension and revocation of Occupational licenses.  Currently under Section 18-40 the City Manager has authority to suspend an occupational license with an automatic appeal to the City Commission.  Additionally, the proposed ordinance change grants the City Manager the authority to revoke an occupational license if the health, safety or welfare of the City’s residents is threatened by the continued operation of the licensed business. As requested by the City Commission, the Ordinance has been amended to require a copy of the governing Ordinance be provided with the notice of suspension or revocation.

 

At the May 2, 2007 Commission meeting, the Commission requested the City Attorney  research whether a Special Magistrate can hear the appeal of a suspended or revoked Occupational License.  The City Attorney researched the matter and found that the option is available.  If desired, the Special Magistrate Appeal may be inserted into lines 29, 34, 36, and 37, in lieu of the City Commission.
